1.1. This website can be accessed at www.tenthsports.co.za (“the Website”) and is made available by Tenth Mega Sports Store (Pty) Ltd (“Tenth Mega Sports”, “we”, “us” or “our”).

1.2. These Website Terms and Conditions (“Terms”) govern the advertising and sale of sports apparel, footwear, equipment, and accessories (“Products”) offered on the Website.

1.3. These Terms are binding upon every person that accesses or uses the Website or registers as a user (“you” or “your”). By accessing or using the Website, you acknowledge that you have read and agree to be bound by these Terms.

1.4. These Terms include our Privacy Policy. Acceptance of these Terms includes acceptance of the Privacy Policy.

1.5. If any provision in these Terms is unclear, it is your responsibility to seek clarification from Tenth Mega Sports before continuing to use the Website.

1.6. Tenth Mega Sports Store (Pty) Ltd permits the use of this Website subject to these Terms. You must not use the Website if you do not agree to these Terms.

2. Important Notice

2.1. These Terms apply to users who are consumers under the Consumer Protection Act, 68 of 2008 (“CPA”). Certain provisions may:

• Require you to indemnify Tenth Mega Sports or a third party;

3.1. By accessing and/or using the Website, you agree to be bound by these Terms.

3.2. Tenth Mega Sports may modify these Terms at any time. The modified Terms will be posted on the Website, and each time you access or use the Website, you agree to be bound by the modified Terms.

4. Content of the Website

4.1. While every effort is made to keep information on the Website up to date, Tenth Mega Sports makes no warranties regarding the accuracy, completeness, or reliability of any information, data, or content on the Website.

4.2. Tenth Mega Sports reserves the right to change or discontinue any aspect of the Website without notice.

5. Registration and Use of Website

5.1. Only registered users may purchase Products on the Website.

5.2. If you use the “Guest Checkout” option, you will be required to register at the end of checkout if you wish to track your order.

5.3. To register or log in, you must provide a username and password (together with any other unique identifying information) as your “Access Codes”.

5.4. You undertake to keep your Access Codes confidential and to immediately notify Tenth Mega Sports of any unauthorized use.

5.5. Tenth Mega Sports may suspend or deactivate your Access Codes if unauthorized use is suspected.

5.6. You may be required to change your Access Codes periodically.

5.7. By using Access Codes, you warrant that you are 18 years or older and have legal capacity. If under 18, you must have parental or legal guardian supervision.

6. Verification

6.1. All electronic communications from an originator using your Access Codes will be deemed to originate from you.

6.2. You waive any rights against Tenth Mega Sports arising from losses due to Tenth Mega Sports acting on instructions from your Access Codes, unless due to Tenth Mega Sports’ gross negligence.

7. Orders, Confirmation & Delivery

7.1. The advertising of Products on the Website constitutes an invitation to make an offer. Tenth Mega Sports reserves the right to reject any order without liability.

7.2. Prices and product information may be subject to error. Tenth Mega Sports is not liable for inaccurate information except in cases of gross negligence.

7.3. Upon submission of an order, you may review and correct errors before final confirmation. By clicking “Confirm”, you submit an offer to purchase.

7.4. Tenth Mega Sports may cancel any order without liability. Acceptance of an order occurs when we deliver the Products or when you collect them.

7.5. Delivery times are estimates only. Tenth Mega Sports is not liable for delays outside its control.

7.6. Risk in the Products passes to you on delivery to your nominated address.

8. Performance & Availability of Products

8.1. Tenth Mega Sports will endeavour to deliver orders within estimated timeframes, but delays may occur due to factors beyond our control.

8.2. Product availability is not guaranteed. If a Product is unavailable, Tenth Mega Sports will notify you and refund any payment made for that Product.

9. Payments/Tenders

9.1. We accept payments via credit card, debit card, Instant EFT, Buy Now Pay Later services, and Tenth Sports Gift Cards.

9.2. By submitting your order, you warrant that you are authorized to use the chosen payment method and that sufficient funds are available.

9.3. Payment is debited at the time of order confirmation. Payment verification may be required; failure to provide verification may result in order cancellation.

11. Returns

Please refer to our Refund & Exchange Policy for details on returns and exchanges.

12. Cancellations

12.1. You may cancel your order within 7 days of receipt under the Electronic Communications and Transactions Act. Return shipping costs for cancellations are your responsibility.

12.2. To cancel an order, contact Customer Care at support@tenthsports.co.za before delivery.

13. Gift Cards

13.1. Tenth Sports Gift Cards are valid for 3 years from purchase and cannot be exchanged for cash.

13.2. Gift Cards cannot be used to purchase other Gift Cards. Unused balances remain on the card until expiry.

14. Vouchers

14.1. Vouchers are issued at our discretion and subject to terms specified at issuance.

14.2. Only one Voucher may be used per order. Vouchers cannot be redeemed for cash or used to purchase Gift Cards.

14.3. Vouchers are valid only on normal-priced items, not on sale items.

15. Privacy & Security

15.1. All personal information collected on the Website is protected under our Privacy Policy.

15.2. Intellectual property rights in all materials and content on the Website are owned by Tenth Mega Sports or licensed. Unauthorized use is prohibited.

16. External Links

16.1. External links are provided for convenience. Tenth Mega Sports is not responsible for content on third-party sites.

16.2. Linking to our Website or framing content requires prior written permission.

17. Unlawful Use

17.1. You shall not use the Website to post or transmit any unlawful, abusive, or offensive material. You indemnify Tenth Mega Sports against any loss arising from your misuse.

21.1. These Terms constitute the sole agreement between you and Tenth Mega Sports regarding use of the Website.

21.2. No waiver of any provision shall be effective unless in writing.

21.3. If any clause is unenforceable, it will be severed, and the remainder will remain in force.

21.4. Force majeure events will suspend obligations until the event ceases. If it continues beyond 14 days, either party may terminate.

21.5. Time periods are calculated in GMT+2.

21.6. These Terms apply to all transactions via the Website.

21.7. Any communications to us are deemed received only upon written acknowledgement.

22. Dispute Resolution

22.1. These Terms and any dispute arising therefrom are governed by the laws of South Africa.

22.2. Any dispute shall be referred to arbitration at the Arbitration Foundation of Southern Africa, Cape Town, in accordance with its rules. The arbitration award will be final and binding.
